REUTERS: Britain's competition regulator said on Thursday it has opened an investigation into Apple Inc after complaints that the iPhone maker's terms and conditions for app developers are unfair and anti-competitive. The Competition and Markets Authority said the investigation will consider whether Apple has a dominant position in the distribution of apps on Apple devices in the UK. Apple charges a commission of up to 30per cent to developers on the value of transactions or any time a consumer buys their app. The regulator said it will also investigate if Apple imposes unfair or anti-competitive terms on developers using the App Store. "We look forward to working with the UK Competition and Markets Authority to explain how our guidelines for privacy, security and content have made the App Store a trusted marketplace for both consumers and developers," Apple said in a statement. Technology may move at the speed of electrons, but the law tends to slouch stubbornly along like — well, like an ass. For all the hubbub about the billion-dollar jury decision in the Apple-Samsung lawsuit (and despite Apple moving forward with a bid to ban eight specific mobile gadgets ), we're not even close to a final resolution of round one in this case — let alone an appeal. That's great news for the lawyers (Apple's team at Morrison Foerster, whose email addresses all read "mofo.com", is billing at a median rate of $581 an hour, according to court documents ). It's not so great for consumers who want to figure out which phone to buy, or any company that feels the chill of potential patent infringement. And it'll be a disappointment to anyone used to the lightning pace of social media and Silicon Valley. What's Next? Mark this date in your calendars, trial watchers: September 20. That's when Judge Koh, who to her credit kept the four-week trial zipping along as fast as … [Read more...] about Apple vs. Samsung Continued: Why This War is Far From Over

While Samsung was found guilty Friday of infringement with 28 different devices, many of those devices are no longer being sold in the United States, which makes the list of potentially banned handsets pretty slim. In the filing Apple says it "has tailored this list to address a portion of the immediate, ongoing irreparable harm that Apple is suffering." bringing the list of 28 offending devices down to eight that are currently on the market. The list includes: Galaxy S 4G, AT&T Galaxy S2, Galaxy S2 Skyrocket, Galaxy S2 T-Mobile, Galaxy S2 Epic 4G, Galaxy S Showcase, Droid Charge, Galaxy Prevail. The jury has reached a verdict in the Apple vs. Samsung patent trial taking pace in a San Jose, Calif. court. Apple succeeded in the majority of its claims against Samsung, with the jury awarding Apple more than $1 billion in damages and potentially banning several Samsung devices from the U.S. market. The jury validated almost all of Apple's claims against Samsung, for many different smartphones and tablets, putting the South Korean electronics giant on the hook for $1.049 billion. The jury also found that at least some of the infringement was "willful," which helped lead to the high figure. (Take a look at the complete verdict form here .) Among the Apple-patented features Samsung devices were found to have been infringing upon: the "bounce-back" that happens when you scroll to the end of a list, double-tap zoom, pinch-to-zoom as well as the design and iconography on iPhones, iPads and iPod Touches. The Samsung devices affected include the Galaxy S, Galaxy S II, Nexus S, … [Read more...] about Apple vs. Samsung Verdict Is In: Apple Wins
Court documents released during the ongoing Apple and Samsung patent battle show early pictures of what the iPhone and iPad could have looked like, and hint at what features we could see in the future. According to images obtained by The Verge , early prototypes of the iPad featured kickstands and side handles. Meanwhile, an image of an iPhone touted diagonal corners which resembles the Motorola Photon 4G , as well as one with an elongated 16:9 display (with only half of the display featuring touchscreen capabilities). Some of these features have even been rumored to be mock-ups of next-generation Apple models. To add fuel to the fire, some of the prototype images have the name "Sony" emblazoned on the back. The news comes one week after another released court document revealed early pictures of the iPad from as possibly far back as 2002. The prototype was visibly thicker than the iPad model that launched in 2010 — likely due to tech advancements made within that … [Read more...] about Secret Pictures of Apple Prototypes Pop Up in Court
