EU top court rules Polish judges can appeal nominations

Judges applying to join Poland's Supreme Court should have the right to appeal against the opinions of a body which reviews candidates, the European Union's top court ruled on Tuesday. Tuesday’s verdict by the Court of Justice of the European Union said the final decision in such cases rested with a Polish court. The ruling underlines the ongoing rift between the EU institutions and the Polish government over rule of law. But critics say the way judges are appointed has become a tool to politicize the judiciary. Poland is in a long-running row with the EU over reforms that the bloc says hurt court independence by increasing political control over judges. The nationalist Law and Justice party (PiS) says the reforms are necessary to make courts more efficient. What did the court say? SDP’s John Tan remains disqualified from contesting elections after High Court dismisses application

SINGAPORE: Opposition politician John Tan remains disqualified from standing for election as a Member of Parliament (MP) after the High Court on Wednesday (Nov 6) dismissed his application for a declaration allowing him to do so. John Tan Liang Joo, who was re-elected into the Singapore Democratic Party (SDP)’s Central Executive Committee (CEC) on Oct 31 , had sought a declaration from the court that would allow him to contest the next General Election (GE). He was fined S$5,000 in April this year after he was found guilty of contempt of court. The Attorney-General’s Chambers (AGC) had initiated the contempt case against him following a Facebook post supporting activist Jolovan Wham, who was also fined for contempt of court. Isis bride Shamima Begum left ‘angry, upset and crying’ after court blocks UK return

Shamima Begum has been left "angry, upset and crying" after a court ruled she could not return to Britain to fight a citizenship battle, friends said. The ISIS bride is now stuck in a detention camp in Syria after the Supreme Court unanimously turned down her request to come back to Britain yesterday. Ms Begum left east London with two friends when she was aged 15 to join the terror group, which led to her British citizenship being revoked on grounds of national security. The now 21-year-old has not spoken to journalists since the verdict. But friends say the decision to block her return to Britain has left her devastasted. Do you have a view on this story? Contempt of court: Apex court dismisses appeals by opposition politician John Tan, activist Jolovan Wham

SINGAPORE: The Court of Appeal on Monday (Mar 16) dismissed appeals by social activist Jolovan Wham and opposition politician John Tan against their convictions and sentences for contempt of court . This means that Tan, who was re-elected into the Singapore Democratic Party's (SDP) Central Executive Committee last October, cannot contest the next General Election. Anyone who is fined at least S$2,000 or jailed a year or more for an offence would be disqualified from running for election as a member of parliament for five years, under Singapore's Constitution. Wham and Tan were each fined S$5,000 in April last year over a Facebook post that Wham penned and Tan referred to in another post on his own page. Wham had said in his public post in April 2018 that Malaysia's judges "are more independent than Singapore's for cases with political implications". Toolkit case: Mumbai-based Nikita Jacob’s bail plea on March 9

Mumbai: A Delhi Court on Tuesday said that it will hear Mumbai-based activist lawyer Nikita Jacob 's anticipatory bail plea on March 9, a day before her protection from arrest ends in connection with the 'Toolkit' case related to the farmers' agitation. Additional Sessions Judge Dharmender Rana adjourned the matter after he was apprised by the Delhi Police that they need more time to file a comprehensive reply to the application and that it be kept with a similar plea by co-accused Shantanu Muluk on March 9. On February 17, Bombay High Court had granted three weeks transit anticipatory bail to Jacob with a direction to approach the court concerned in Delhi, where the case is lodged. Her protection from arrest ends on March 10. Disha Ravi and Shantanu Muluk, faces charges of conspiracy and sedition in the case. Muluk and Jacob had joined the investigation at Delhi Police's Cyber Cell office in Dwarka on February 22.
